To comply with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations Rembrella Ltd. is required to provide you with terms and conditions regarding your purchase. Your statutory rights under the current consumer protection laws are not affected.

Registration of Design

Rembrella Ltd. holds registered designs for The Poppy Umbrella: GB - 2063352; FR - 974774; BX - 28828 - 00. The registered designs are protected by the Enforcement Database and customs watches for the UK, France, Belgium, the Netherlands and Luxembourg.

Goods

  1. The Poppy Umbrella is available in various frame styles, the full details of which are provided on this website at www.rembrella.co.uk/products.htm.
  2. Rembrella Ltd. reserves the right to change manufacturers of the product or to make changes to the frames and fabric, which may result in a slight modification to the product currently in stock.
  3. The Poppy Umbrella is authorised for sale by Rembrella Ltd. from:
    • Rembrella Ltd.
    • from retail outlets or online shop catalogues authorised by Rembrella Ltd to retail The Poppy Umbrella.

Payment & Processing of an Order

  1. The country of Merchant Location of Rembrella is the United Kingdom. Transactions by Rembrella Ltd. are in the currency of United Kingdom Sterling (Great Britain Pound).
  2. Goods are the property of Rembrella Ltd. until payment has been settled in full.
  3. Payment for an order of goods and delivery will be requested by invoice. New customers and international customers will be required to make payment in full prior to despatch of the goods.
  4. Payment by bank transfer. Details for payment will be advised by Rembrella Ltd.
  5. Payment by cheque drawn on a United Kingdom bank in Sterling. Cheques should be made payable to Rembrella Ltd. and sent to Rembrella Ltd., 12 Oak Ash Green, Wilton, Salisbury SP2 0RR, England.
  6. Rembrella Ltd. will advise the date of despatch of an order and when payment by cheque or bank transfer has cleared.
  7. Sales Receipt. A sales receipt confirming the receipt of payment will be enclosed with the goods and delivery note when the goods are despatched or will be sent separately according to the customer's requirements. The Personal Data printed on a sales invoice/receipt will consist of:
    • the name and address of the person/organization for payment of the invoice.
    • the name and address (if different) for the delivery.
    • a contact name and telephone number in connection with the delivery.
  8. Commercial Invoice. Parcels to international destinations outside Europe will be accompanied by a Commercial Invoice (3/5 copies) for customs purposes to show the price paid for goods, which are excluded UK VAT tax @ 20%. Personal Data printed on the Commercial Invoice is:
    • the name and address of the recipient of the goods
    • a contact telephone number.

Delivery

  1. Rembrella Ltd. will advise the date for the despatch of the goods. Rembrella Ltd. will advise costs and delivery schedules to be agreed by the customer in advance of shipping the goods.
  2. During a busy period of orders Rembrella Ltd. reserves the right to despatch the goods within 28 days of the date of receipt of an order. Rembrella Ltd. will advise of any delay in the despatch of an order.
  3. Delivery to UK, BFPO, EU and Europe: Goods are despatched by post using Royal Mail, courier or Parcelforce postal services.
  4. Delivery to international destinations outside Europe: Goods are despatched by Royal Mail air mail or by international courier air mail parcel post or road freight as appropriate. Customers are advised that there may be import customs duty charges on receiving goods into the country. It is the responsibility of the customer to pay all import customs duty and broker's fees.
  5. On despatch of an order Rembrella Ltd. will contact the customer via the email address or telephone number supplied by the customer to advise when to expect the arrival of the goods. If the goods do not arrive within a reasonable time after the expected date of delivery please contact Rembrella Ltd. by email at orders@rembrella.co.uk or by telephone on +44-1344-989 802. In the unlikely event that the goods are lost in transit written confirmation will be required to confirm that the goods have not been received and replacement goods can be despatched.

Rembrella’s Right to Cancel

Rembrella Ltd. reserves the right to cancel an order in the following circumstances:

  1. If, for reasons beyond our reasonable control, including but not limited to an inability or failure on the part of the manufacturers or suppliers of the goods to supply the goods to us, we are unable to supply the goods to you, we may cancel the agreement at any time before the goods are delivered by giving notice to you. Any sums paid by you (or on your behalf) will be repaid promptly.
  2. We are unable to obtain authorisation for your payment and you do not respond to an email, telephone call or letter from us in this respect.
  3. An error in the pricing or product description is identified by Rembrella Ltd.

Returns & Refunds

Our returns and refunds policy is in accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations.

14 Day Cooling Off Period: Return of the Goods & Your Refund

  1. If you cancel your purchase during the 14 day cooling off period you should return the goods within 14 days of a written cancellation.
  2. You must take reasonable care of the goods whilst they are in your possession. The goods must be returned to Rembrella Ltd. in a saleable condition and as they were received by you. Rembrella Ltd. has a right to deduct monies from refunds where goods show unreasonable use leading to diminished value.
  3. You are responsible for the payment of the return delivery of the goods. Contact Rembrella Ltd. if you require advice (telephone: +44-(0)1344-989 802; email: orders@rembrella.co.uk).
  4. You are advised to pack and seal the product carefully in suitable packaging to avoid damage on the return delivery. Enclose the customer contact name, address and Rembrella’s invoice reference number. Rembrella Ltd. will not accept liability for returned goods if they are damaged in transit due to unsuitable packaging.
  5. In the event that the goods fail to be returned to Rembrella Ltd. or the charge for their return is at the expense of Rembrella Ltd., the direct costs of their recovery may be offset from the refund of the sum being repaid to you.
  6. The amount paid to Rembrella Ltd. for your purchase will be refunded to you by bank transfer or by cheque within 14 days of the returned goods being received by Rembrella Ltd.

Faulty Goods or Dissatisfaction

  1. In the event that you find a fault with the goods or you are dissatisfied with the goods supplied because they do not conform to contract, and a replacement is not acceptable, a refund will be made. The goods need not be returned unless requested by Rembrella Ltd. for the purpose of investigation of the reported fault. In this case Rembrella Ltd. will refund or arrange payment for the return of the goods. You must contact Rembrella Ltd. in writing, including the customer contact name and address (and Rembrella’s invoice reference number as appropriate) either by email to orders@rembrella.co.uk or by letter to Rembrella Ltd., 12 Oak Ash Green, Wilton, Salisbury SP2 0RR, England. Damage in transit or late delivery

  1. Rembrella Ltd. relies on the Royal Mail postal service or courier (as applicable) to provide safe delivery of the goods you have ordered. If damage has occurred to the product during delivery please contact Rembrella Ltd. in writing immediately it is received, including a customer name and address either by email to orders@rembrella.co.uk or by letter to Rembrella Ltd., 12 Oak Ash Green, Wilton, Salisbury SP2 0RR, England. You will be required to hold the item(s) for investigation. Rembrella Ltd. will offer replacement goods or a full refund will be made to you.

Privacy & Disclosure

Rembrella Ltd. respects your right to privacy. Personal Data collected from you or your organization at the time you place an order is used only to fulfil an order.

  1. The Personal Data accessed by Rembrella Ltd. to fulfil an order is:
    • the contact name and address of the customer or organization purchasing the order
    • a contact name and address for delivery (if different)
    • an email address
    • a telephone number.
  2. This Personal Data is used only to:
    • (1) email confirmation of the order
    • (2) print an invoice/receipt for the payment
    • (3) print a label and delivery note with the name and address for delivery
    • (4) send an email from Rembrella Ltd. to notify you of the despatch date of the goods. If the goods are to be despatched by courier the delivery name, delivery address and contact telephone number will be typed by Rembrella Ltd. into a secure online booking system maintained by the courier. The courier used by Rembrella Ltd. is Citysprint, which complies with GDPR regulations.
  3. Rembrella Ltd. will contact you in connection with an order, its despatch from Rembrella Ltd. and, as appropriate, in connection with payment for an order.
